According to multiple sources, talks between Macy’s and Penney fizzled, making it likely that a judge will have to decide the dispute over home goods designed by Martha Stewart.

New York -- Martha Stewart Living Omnimedia and J.C. Penney Co. on Monday announced a revised commercial agreement covering their licensing and design partnership. The new agreement scales back Penney’s partnership with Martha Stewart Living.
    
It was not clear how, if at all, the revised agreement could affect the companies’ ongoing lawsuit with Macy’s.

Martha Stewart has agreed to reduce her annual base salary by $200,000 to $1.8 million.

New York -- Martha Stewart has agreed to reduce her annual base salary by $200,000 to $1.8 million.

Stewart, founder and chairwoman of Martha Stewart Living Omnimedia Inc., also gave the green light to allow the company to reduce her annual licensing fee by $300,000 to $1.7 million, according to a regulatory filing Wednesday.

The cuts, according to company executives, are “consistent with their plan to return ... to profitability.”

MSLO reported a net loss of $3.27 million for the first quarter ended March 31.

A New York State judge on Thursday said he case will not be tried before a jury and there will be no need to decide damages.
 
Instead, any potential damages in the dispute “are going to pale in comparison to the injunction,” the judge said. “That’s the real big bucks there -- if I stop this deal.”

New York -- Martha Stewart Living Omnimedia said Monday it has named Michael Robinson to the newly created position of VP e-commerce.

Robinson was most recently Anthropologie’s head of e-commerce for Europe and United Kingdom, and was responsible for launching the Anthropologie catalog and website in 1998, as well as introducing the retailer’s loyalty card program.

He has also held managerial and planning positions with Banana Republic and Smith & Hawken.

The chain currently offers paint, outdoor furniture, kitchen and bath cabinetry and carpeting under the Martha Stewart brand currently. It plans to expand its product lineup with a new craft furniture line and more holiday merchandise.

Framingham, Mass. -- Staples has partnered with Martha Stewart Living Omnimedia to create a new line of home office items that have female appeal.

The line, to be called Martha Stewart Home Office, will be made by Avery Dennison Corp. and will include some 300 products. The items will make its debut in Staples stores in early 2012.

“Department stores from Macy’s to Nordstrom, and mall operators from Macerich to Simon, have used the recession not just to cut costs, but to reinvent themselves,” said Craig Johnson, president, Customer Growth Partners, a consulting and research firm serving retail and other consumer industries.
