Martha Stewart Living Omnimedia Inc. has named board member Daniel W. Dienst, who most recently served as CEO of Sims Metal Management, as CEO.

New York -- Martha Stewart Living Omnimedia Inc. has named board member Daniel W. Dienst, who most recently served as CEO of Sims Metal Management, as CEO. The position has been vacant since December, when chief executive since Lisa Gersh left the media and merchandising company.

Dienst served as chairman and CEO of Metal Management Ltd. from 2003 to 2008, when it was sold to Sims. He then took the helm at the newly combined company.

Terry Lundgren, CEO of Macy’s, took the stand on Monday to testify in the trial of two Macy's lawsuits regarding the deal between J.C. Penney Co. and Martha Stewart Living Omnimedia Inc.

New York -- Terry Lundgren, CEO of Macy’s, took the stand on Monday to testify in the trial of two Macy's lawsuits regarding the deal between J.C. Penney Co. and Martha Stewart Living Omnimedia Inc. The long-awaited trial began last Wednesday, in New York Supreme Court.

The trial is about whether Macy’s has the exclusive right to sell Martha Stewart branded cookware, bedding and certain other products.

The battle between Macy’s Inc., J.C. Penney Co., and Martha Stewart Living Omnimedia Inc. will go to trial Feb. 19, Bloomberg reported.

New York -- The battle between Macy’s Inc., J.C. Penney Co., and Martha Stewart Living Omnimedia Inc. will go to trial Feb. 19, Bloomberg reported.

A New York State judge on Thursday said he case will not be tried before a jury and there will be no need to decide damages.
 
Instead, any potential damages in the dispute “are going to pale in comparison to the injunction,” the judge said. “That’s the real big bucks there -- if I stop this deal.”

Bloomberg reported that Macy’s Inc. has filed suit against J.C. Penney Co. in New York state court over the rights to sell products branded by Martha Stewart Living Omnimedia Inc. in their respective department stores.

Macy’s sued Martha Stewart Living in January to stop it from executing a sales agreement with J.C. Penney, as Macy’s claimed an exclusive right to sell Martha Stewart products in certain categories.

Macy’s sued Martha Stewart Living in January to stop the company from executing a sales agreement that it announced in December with J.C. Penney Company.  Macy’s said it had the exclusive right to sell Martha Stewart-branded products in certain categories.

A report by Bloomberg said that Macy’s CEO Terry Lundgren is slated to give his deposition next month over a contract dispute with Martha Stewart Living Omnimedia Inc.

New York -- A Thursday report by Bloomberg said that Macy’s CEO Terry Lundgren is slated to give his deposition next month over a contract dispute with Martha Stewart Living Omnimedia Inc.

Citing documents filed Thursday in New York state court, Bloomberg said that Lundgren is scheduled for a half-day of questioning on July 3 in advance of a July 13 hearing on his company’s request for a preliminary injunction.

A New York state Supreme Court filing on Monday disclosed that Macy’s Inc. is suing Martha Stewart Living Omnimedia Inc. for breach of contract after Martha Stewart set up a new deal last December with J.C. Penney to sell products at its stores.

New York City -- A New York state Supreme Court filing on Monday disclosed that Macy’s Inc. is suing Martha Stewart Living Omnimedia Inc. for breach of contract after Martha Stewart set up a new deal last December with J.C. Penney to sell products at its stores.

According to Macy's, Martha Stewart Living granted it product exclusivity under a 2006 agreement. J.C. Penney, which acquired a 16.6% stake in the company in December, plans to open Martha Stewart Living in-store shops, beginning in 2013, which violates that exclusivity, said Macy’s.
