Retailers, like all businesses, constantly seek to learn more about their customers in order to serve them better. In Tyler v. Michaels Stores, however, the Massachusetts Supreme Judicial Court recently ruled that a simple step taken by many retailers to help achieve this goal – collecting the ZIP codes of their customers at the point of sale – can in some circumstances violate Massachusetts’ consumer protection statute.

Walmart is easing the pain at the pump by offering customers who use a Walmart MoneyCard or Walmart Credit Card a 15 cents per gallon reduction on their fuel purchase.

Bentonville, Ark. -- Walmart is easing the pain at the pump by offering customers who use a Walmart MoneyCard or Walmart Credit Card a 15 cents per gallon reduction on their fuel purchase. Customers using a Walmart gift card will receive a 10 cent per gallon discount. Gas will be discounted at more than 1,000 Murphy USA and Walmart gas stations located at Walmart stores in 21 participating states.

Research results released by Temkin revealed that, based on a study of 10,000 U.S consumers, American Express and USAA earned the top spots in the credit card sector.

Waban, Mass. -- Research results released Monday by Temkin revealed that, based on a study of 10,000 U.S consumers, American Express and USAA earned the top spots in the credit card sector.

According to the 2013 Temkin Experience Ratings, HSBC was the lowest rated credit card issuer for the third consecutive year.

"USAA and American Express set the pace for customer experience in credit cards while HSBC is a real black sheep in the industry," said Bruce Temkin, managing partner, Temkin Group.

Capital One Financial Corp. said Tuesday that it will sell off its Best Buy portfolio of private-label and co-branded credit card accounts.

McLean, Va. -- Capital One Financial Corp. said Tuesday that it will sell off its Best Buy portfolio of private-label and co-branded credit card accounts. Current loan balances total about $7 billion.

The pair is severing their ties earlier than expected – the break-even sale of the portfolio to Citi is expected to finalize in third quarter 2013.

New York -- Barnes & Noble said it has detected tampering with PIN pad devices that are used in 63 of its stores. Upon detecting evidence of tampering, which was limited to one compromised PIN pad in each of the affected stores, chain discontinued use of all PIN pads in its nearly 700 stores nationwide by the close of business on Sept.14.
 
In addition, the company notified federal law enforcement authorities, and has been supporting a federal government investigation into the matter.

Target Corp. said Tuesday it will sell its $5.9 billion credit card portfolio to TD Bank Group.

Minneapolis -- Target Corp. said Tuesday it will sell its $5.9 billion credit card portfolio to TD Bank Group.

The business will be sold for an amount equal to the gross value of the outstanding receivables at the time of closing, said Target; the portfolio currently has a gross value of about $5.9 billion.

TD Bank also agreed to a seven-year deal to underwrite, fund and own the retailer’s future credit card and Visa receivables in the U.S.

Alliance Data Systems Corp. said that it has acquired the receivables associated with The Talbots Inc.’s existing private-label credit card file, and will acquire the credit card accounts, pending regulatory approval.

Dallas -- Alliance Data Systems Corp. said Monday that it has acquired the receivables associated with The Talbots Inc.’s existing private-label credit card file, and will acquire the credit card accounts, pending regulatory approval. The receivables portfolio totals about $145 million.

Alliance Data also said that its Retail Services business will provide private-label credit card services for Talbots, as well.

DSW Inc. said that it has been awarded $7.2 million as a result of litigation with its insurance carrier stemming from its credit card data breach in 2005.

Columbus, Ohio -- DSW Inc. said Thursday that it has been awarded $7.2 million as a result of litigation with its insurance carrier stemming from its credit card data breach in 2005.

The $7.2 million award represents damages plus accrued interest.

In other news, DSW has declared a special dividend totaling $91 million to be paid on Oct. 26 to shareholders. According to president and CEO Mike MacDonald, the special distribution, which is in addition to the regular dividend, represents “significant cash flow generation.”

The program will offer shoppers using a Walmart gift card a 10-cents-per-gallon discount. Those who use a Walmart MoneyCard or Walmart credit card will save 15 cents per gallon. The discounts will be available at more than 1,000 Murphy USA and Wal-Mart gas stations in 20 states.

Dallas -- Alliance Data Systems has agreed to acquire The Bon-Ton Stores’ private-label credit card portfolio worth $475 million.

Financial terms of the deal were not disclosed.

Alliance Data, which provides private-label credit card services to retailers, will also manage the retailer's private-label credit card program.

Bon-Ton Stores, Inc., operates 272 stores in 23 states across the Northeast, Midwest, and upper Great Plains, under a variety of banners.
